Nortel vs. the Environmental Ministry   Leave a comment

The recently bankrupt Nortel Networks is refusing to spend $10 million on environmental clean up of a site in Ontario. Nortel argues that it can not afford the $10 million for the environmental clean up despite the fact that they are soon to receive $900 million for selling all the patents they currently hold. Nortel also argues that bankruptcy law trumps environmental law, a proposition which I find absurd at best. They also claim that a a previous court order protects Nortel against enforcement orders and so they can not be forced to pay to clean up their site. The sad part is that while this legal debate plays out, more toxins and PCBs are being inhaled by innocent bystanders.
